Terms of Service

These Terms of Service ("Terms") are an agreement between you and 17907583 Canada Inc., a federally incorporated Canadian corporation under the Canada Business Corporations Act, operating as Open Case Co ("Open Case Co," "we," "us," or "our"). Open Case Co is a trade name of 17907583 Canada Inc.

By creating an account, making a purchase, or using our website and services, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, please do not use our services.

• You must be at least 18 years old.
• Our services are offered to customers in Canada and the United States. They are not currently offered to residents of the Province of Quebec. We hope to add Quebec, with French-language terms, in the future.
• You must give accurate account information and keep your sign-in details secure. You are responsible for activity under your account; tell us promptly at support@opencaseco.com if you suspect unauthorized access.

We sell digital murder-mystery party games ("Products"): downloadable PDF files including a host guide, character packets, clues and a sealed solution. We also offer a yearly subscription, AI-assisted mystery generation for subscribers, and host-assistance features.

Content notice. Fictional murder-mystery game with crime and mature themes. Intended for adults (18+). The stories are fiction; any resemblance to real people or events is coincidental.

• All prices are in US dollars (USD). A single mystery is US$29; the yearly subscription is US$99 per year.
• Applicable taxes (for example GST/HST, provincial sales tax or US sales tax) are added at checkout and shown before you pay. Your bank may charge currency-conversion fees.
• Payments are processed by Stripe. We never see or store your full card number.
• Delivery is digital: purchased files are available to download from your account immediately after payment, and we email you a receipt.

Your subscription renews automatically every year at US$99 plus applicable tax, charged to your payment method on file, until you cancel.

• You are charged when you subscribe and on each yearly anniversary of that date.
• We email you a reminder at least 30 days before each renewal, with the amount, the renewal date and how to cancel.
• How to cancel: anytime, from your dashboard (Manage Billing → cancel), or by emailing support@opencaseco.com from your account email address. We confirm every cancellation by email.
• Cancelling stops the next renewal. You keep access until the end of the year you have paid for. Mysteries you downloaded are yours to keep.
• Each subscription year includes 12 mystery download credits and 12 AI mystery generator credits, available immediately. Unused credits expire at renewal or when the subscription ends; they have no cash value.
• Price changes: if the subscription price changes, we will email you at least 30 days before the new price applies to your next renewal, with instructions to cancel. If you do not cancel, the new price applies from that renewal.
• Refunds for subscriptions are covered in our Refund Policy.

Because our Products are delivered instantly as downloads, refunds are limited. In short: you may request a refund within 7 days of purchase if you have not downloaded the files (for subscriptions: if no credits were used and the bonus mystery was not downloaded). The full rules are in our Refund Policy. Nothing in these Terms limits any refund or cancellation right you have under the consumer-protection law where you live.

When you buy or claim a Product, we grant you a personal, non-exclusive, non-transferable license to:

• download, print and use it for private, non-commercial games with your friends, family or other personal guests;
• re-download it from your account; and
• print as many copies as your own game nights need.

You may not:

• resell, share, upload or otherwise distribute the files, or give them to people outside your game;
• use them commercially without a commercial license (see section 8);
• remove copyright notices or branding; or
• use automated tools to scrape our site, or try to copy or reverse-engineer our AI generation systems.

Commercial use needs a commercial license. That includes running a game where tickets or admission are sold, using a game for clients as an event planner, hosting it at a restaurant, bar or venue, or running it as corporate team-building. To ask for a license and a quote, email support@opencaseco.com.

Non-profits, schools and libraries: if you would like to use our games for a charity event, classroom or library program, please contact us at support@opencaseco.com and tell us about it. We are happy to talk about options.

• Subscribers can generate custom mysteries with our AI tools. What you type is sent to our AI provider to produce the result (see our Privacy Policy).
• You may use mysteries you generate on the same terms as purchased Products (section 7).
• AI output can contain mistakes. Please review generated content before using it; we do not guarantee its quality, accuracy or playability.
• Do not enter other people's personal information or anything unlawful.

All Products, text, graphics, designs and software are owned by 17907583 Canada Inc. or its licensors and protected by copyright and other laws. Your license does not transfer ownership.

You agree not to break the law, infringe others' rights, try to access our systems without permission, interfere with the service, upload malicious code, or harass or harm others.

To the extent the law allows, our services are provided "as is." We do not promise they will be uninterrupted or error-free. To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Nothing in these Terms excludes or limits any right, warranty or remedy that the consumer-protection law where you live does not allow to be excluded or limited.

To the extent the law allows, you agree to cover our reasonable losses arising from your breach of these Terms or misuse of the Products.

We may suspend or close an account that breaks these Terms. If we close your account without cause, we will refund the unused part of any prepaid subscription. You may close your account at any time by emailing support@opencaseco.com. Files you already downloaded and paid for remain yours to use under section 7.

We may update these Terms. For material changes we will email account holders and post a notice on the site before the changes take effect. Changes do not apply retroactively to purchases already made. Price changes for subscriptions follow section 5.

These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Subject to the paragraph below, any dispute arising from or relating to these Terms or our services shall be brought exclusively in the courts of the Province of Saskatchewan sitting at Saskatoon, and you and we submit to the jurisdiction of those courts. Before starting a proceeding, please email support@opencaseco.com so we can try to resolve it.

Nothing in these Terms limits any consumer-protection right or remedy that the law of the province, territory or state where you live does not allow to be waived or limited, including any right to bring a claim in your local courts.
